RENTAL CONDITIONS
REQUIRED DOCUMENTATION
A valid driver’s license and a national ID or passport must be presented. Only original documents are accepted.
Payment will be made on the day the vehicle is collected, either at our office or another agreed location.
Accepted payment methods: cash, Visa, Mastercard, or debit card.
If the booking is made through our reservation platform wikirentacar.es, you must present the booking confirmation.
The renter must show a driver’s license with more than 2 years of validity, along with a residence card, national ID, or passport. The driver must be over 24 years old. If these conditions are not met, an additional insurance fee will apply.
At the time of pickup, a deposit will be blocked on the renter’s credit/debit card, or may be left in cash. The amount varies by vehicle model and ranges from €250 to €1,000.
To avoid this charge, a credit card in the name of the driver must be presented.
GENERAL CONDITIONS
The vehicle may not leave the country, except for Portugal and Gibraltar, and only with prior notice.
With the Premium Insurance option, unlimited mileage is allowed within Andalusia for rentals under 20 days.
For monthly rentals, 3,000 km are included within Spanish territory. Excess mileage will be charged based on the company’s rates or deducted from the deposit.
Insurance will be void in case of driving under the influence of alcohol, drugs, unauthorized medication, or speeding. Any resulting damage will be the renter’s full responsibility.
Rental prices include the mandatory and supplemental liability insurance.
The insurance policy does not cover theft, lost keys, or damage/loss to luggage, goods, or personal items transported in the vehicle.
Damages to the undercarriage, windows, tires or rims caused by overloading, exceeding speed limits, or driving on beaches, forests, mountain trails, or inappropriate roads are not covered.
The renter must report any accident or damage (interior or exterior) within 24 hours. Failure to do so may result in penalties.
Smoking or vaping is strictly prohibited inside the vehicle. If smoke, ash, or odor is detected upon return, a deep cleaning fee will be charged.
The renter must refuel with the correct fuel type. If not, the renter will bear mechanical and transport costs.
It is forbidden to transport more passengers than authorized or to carry unauthorized goods.
Subleasing the vehicle or using it as a taxi service is not permitted.
The renter is fully responsible for traffic fines or legal violations during the rental period.
If Wiki Rent a Car receives a fine, it will notify the driver using the contact details provided in the rental agreement.
All legal, court, or attorney fees due to misuse of the vehicle are at the renter’s expense.
The rental contract comes into effect at the time and date it is signed upon vehicle pickup.
The vehicle must be returned at the same time as it was picked up, with a 2-hour grace period. Exceeding this will result in a full extra day charge.
To extend the rental, the customer must visit Wiki Rent a Car in person to sign a contract extension and make payment. Extensions cannot be made by phone, email, or SMS.
RENTAL DURATION
The rental duration will be stated on the front page of the contract (start and end date/time).
A rental day equals 24 hours, with a 2-hour courtesy return window.
Maximum contract duration is 30 days, renewable.
If the customer returns the vehicle early, no refund will be issued for unused days.
VEHICLE RETURN AND FUEL POLICY
The vehicle must be returned in the same clean condition as it was delivered. If it has excessive dirt, stains, pet hair, tobacco odor, or missing parts, a €100 fee will apply.
If the vehicle is not returned on the scheduled date and the client does not respond to calls or messages, the company will consider the vehicle misappropriated and will report it to the National Police of Marbella.
The vehicle is delivered with a full tank and must be returned full.
If fuel is missing:
- Less than full tank: €50 fee
- Less than half tank: €100 fee
MILEAGE POLICY
Mileage is unlimited within Andalusia.
If traveling outside Andalusia, the limit is 150 km per day, unless it’s a monthly rental, which includes 3,000 km within Spain.
Extra mileage will be charged at €0.35 or €0.50/km, depending on the vehicle.
LOST ITEMS
Items left in the vehicle will be kept for 2 months. After that, they will be discarded.
BOOKING CANCELLATION
If canceled 48 hours before pickup, the full rental fee will be refunded.
If canceled with less than 48 hours’ notice, no refund will be issued.
To enable last-minute cancellation, customers must purchase the cancellation insurance option on wikirentacar.es.
RIGHT TO CANCEL
Wiki Rent a Car reserves the right to cancel any booking immediately and without compensation, if deemed necessary.
INSURANCE OPTIONS
Basic Insurance
Includes third-party liability only.
- Covers damage to other vehicles.
- Damage to the rental car is subject to an excess/deductible between €800 and €1,500, depending on vehicle.
- Mileage limit: 150 km/day
- No roadside assistance
- Deposit of €250–€600 may apply for lost keys, cleaning, extra day, or missing fuel.
Premium Insurance
- Full coverage with no deductible
- Includes 24h roadside assistance
- Unlimited mileage within Andalusia
- Valid for Portugal and Gibraltar
- Deposit of €250–€600 may apply as above
⚠️ Neither insurance covers tires, glass, or undercarriage. To include this coverage, you must purchase the “Garantía Plus” on our website.
CONTRACT SIGNATURE
All conditions listed in this contract and its annex are deemed read and accepted upon signature.
TRANSLATION NOTICE
The English translation of these terms is for informational purposes only. The Spanish version is the only legally binding text before any court.
VEHICLE GEOLOCATION
Purpose:
GPS trackers in vehicles will only be activated in cases of theft, suspicion of misuse, roadside incidents, or to help locate the vehicle and provide customer service.
Tracking is also used to calculate mileage.
Legal basis:
Activation is based on Wiki Rent a Car’s legitimate interest in protecting its fleet, under Article 32 of the GDPR. Activation is performed by the authorized GPS provider.
Third-party access:
No data is shared with third parties unless legally required.
Data retention:
Location data is deleted 30 days after vehicle return, unless required by court order or official request.
Data minimization:
GPS tracking is not used continuously, nor for staff or customer surveillance.
